Midway’s City Council voted Tuesday to reverse a previous approval that would have added 71 South 200 West to the city’s Transient Rental Overlay District, citing new information about public‑hearing testimony.
Mayor Simons brought the matter back under the city’s reconsideration rules after staff reported that a neighbor who had been identified as supporting the expansion later contacted staff to say she had opposed it. Councilmember comments centered on correcting the record and protecting neighbor notice. After a motion to reverse the earlier decision was made and seconded, the council took a roll‑call vote. Councilmembers Andy, Kevin and JC voted in favor and the motion passed.
City staff explained the reconsideration process as a corrective tool in the municipal code that allows a member who voted with the prevailing side to bring an action back for review when new information emerges. Planner remarks in the packet noted that one letter opposing the zone change had been included in the original record and that additional neighbors had expressed opposition.
Speaker 7 during public comment expressed concern that nearby properties undergoing renovations could later be included in the TROT, and staff said a zoning‑map amendment would be required and that notified neighbors would receive mailed notices within 600 feet for any such application.
The council also said it will review trot boundaries and how the overlay interacts with the interface between commercial and residential zones as part of further zoning work.
