Committee approves change to subdivision definition to include structures with up to four units

The committee considered LD 128, a Department of Environmental Protection bill to update the subdivision definition in Title 38. The amendment replaces the phrase "single‑family detached residential housing" with a broader definition covering housing structures that can contain up to four dwelling units (with or without accessory dwelling units) and makes conforming changes throughout the statute. The amendment also clarifies the departments rulemaking authority.

Analysts and the departments representative told the committee the change is strictly for DEPs jurisdictional purposes and should not change definitions used by insurance, taxation or other statutes; those areas are governed by separate law. Committee members asked about downstream effects such as insurance classification and tax status; analysts said those are regulated by separate statutes and the change is limited to DEP's subdivision jurisdiction.

Senator Bennett moved that the committee report LD 128 "ought to pass as amended." The motion was seconded, roll was called, and the committee recorded a unanimous vote in favor. The committee closed the work session and advanced the bill.
