Planning board endorses ANR to convey 2,194 sq ft between 112 and 120 Central Street

The Planning Board reviewed an Approval Not Required (ANR) plan affecting 112 and 120 Central Street that would create a Parcel A containing 2,194 square feet to be conveyed to Daniel and James Kerr at 112 Central Street. According to submitted notes, after conveyance Parcel A is not to be considered a separate lot and will be combined with existing Kerr parcels to form a total of 17,634 square feet (0.405 acres) at 112 Central Street; the remaining portion of 120 Central Street would contain 35,342 square feet (0.811 acres).

A CAPCO consult representative participating remotely described the plan as a basic land swap resulting from an adverse possession case. Board members asked whether both lots will meet zoning area requirements after conveyance; staff member Sarki reviewed the submission and indicated it met the city's needs for ANR endorsement.

A motion to endorse the ANR (approval not required under subdivision control laws) was moved and seconded; the board voted to endorse the plan. The chair said mylar signatures would be collected after the meeting and the mylar would be brought to City Hall for pickup.

The board noted that the litigation context (adverse possession) would have been a useful detail to include in the initial file. No further conditions or additional requirements were recorded in the endorsement motion.
