Assembly briefed on borough code recodification ordinance intended to clean up citations and modernize language

Assemblymember Crass introduced an ordinance (2025-32) to recodify and republish the Fairbanks North Star (Borough) code of ordinances. Staff explained that the borough contracts periodic legal review and codification (roughly every 10 years) to remove expired provisions, correct outdated references to state and federal law, and reorganize chapters so substantive provisions appear in the appropriate subject titles.

Miss Dolan said the process is primarily a legal and clerical clean-up: for example, moving the voter definition into Title 1 where it is used broadly; renaming the investment advisory committee as a commission and propagating that change across code; changing wording such as 'liquor' to 'alcoholic beverages' to reflect current state law; and clarifying appeal, subpoena and record-retention language to match practice and state requirements.

Staff emphasized the recodification does not generally change policy intent but improves clarity and consistency. Some titles received targeted updates: Title 15 (floodplain code) required one federal reference update; Title 17 (subdivision code) corrected appeals language; Title 16 (procurement) consolidated exemption language. Miss Dolan and others said departments were consulted and individual substantive policy changes would be brought to the assembly separately if needed.
