The Linn County Board of Adjustment on Dec. 30 approved a conditional use permit for Arbor Master Tree Service to operate a tree-service business at 2226 Springville Road.
Planning and development staff recommended granting the permit subject to conditions, citing the site’s compatibility with surrounding agricultural uses and measures to minimize visual and traffic impacts. "Staff recommends granting the proposal subject to conditions," the staff presenter said during the hearing.
According to the staff report, the business already stores outdoor materials such as logs, tree debris and mulch on site, and stores business vehicles on the property. The applicant indicated the operation has seven full-time employees who come to the site and two employees with office space on-site; business hours were listed in the packet as 8 a.m. to 5 p.m. The staff presentation noted three fuel tanks on the property that will require permits and follow-up enforcement to ensure compliance.
Conditions attached to the approval include installation of vegetative screening along the eastern edge of the outdoor storage area to mitigate visibility from the road, paving of the property entrances to the property line to limit gravel on the county road, and any required permits for on-site fuel tanks. Staff said vegetative screening may take time to reach mature height on the sloped site but that the applicant agreed to mitigation measures.
The applicant did not make an oral presentation at the hearing. A board member asked whether the action would change the property’s zoning; staff clarified the zoning would remain agricultural and only the tax assessment—not the zoning—might change.
After no public comment, a board member moved to "accept the findings of fact, conclusions of law and decision and order to approve PC250011 as recommended by staff." The motion was seconded and approved by roll call: Alden, Price, Meader and Hoover each recorded a "yes." The decision requires three concurring votes to grant an application; the motion carried unanimously.
The board closed the hearing with the staff and applicant able to follow up on the permit conditions. The case file will be subject to the conditions and any related enforcement follow-up by planning and development staff.
