For 1090 East 1st St., planning staff outlined a history of seasonal temporary approvals dating to 1989 for three recreational vehicles used as transient lodging; the city’s code update ended the ad‑hoc renewal practice and required a vested‑rights determination. Staff said the property obtained utility hookups and permits in prior years and that evidence of investment‑backed expectations existed. The commission approved a development order recognizing a right for three RVs on site seasonally — November through May — with parameters to be memorialized in the order.
For Murphy Enterprises, staff presented aerial imagery, historic permit cards dating to 1959 and neighborhood letters supporting a daycare operation at 1611 and 1701 Murphy Drive dating back decades. Applicant representative Sally Sherman said COVID‑19 closures interrupted operations and that the family invested to restore the operation. After discussing whether the appropriate route was a vested‑rights determination or restarting with conditional‑use review, the commission approved the vested‑rights request to reestablish the daycare use, noting staff’s recommendation and the historical documentation presented.
Both approvals instruct staff to prepare development orders that specify the number of units, seasonality and any conditions or monitoring required. The commission indicated it expects staff to include clear parameters in the development orders so future administrative questions are minimized.
