PSC approves transfer of small Adams County sewer system, orders updated tariff within 30 days

The Public Service Commission approved a petition to transfer ownership of a sewer system serving parts of Adams County and directed the new owner to update the company’s tariff within 30 days.

Staff (Mister Rhodes) told the commission Willow Creek Management LLC requested approval to transfer ownership interest from William Neely to Douglas M. Ballard for the sewer system that serves 147 customers in the Graves Memorial Subdivision, Cedar Village Apartments and Oak Village Apartments. Staff noted the system lacks a tariff on file in Willow Creek’s name, has had no rate increase in 27 years for that customer base, and may be at risk due to low rates and underinvestment. The petitioner agreed to file updated tariff documents with rates, fees, service rules and extension policies within 30 days as required in the order.

Commissioners asked whether the new owner would return in February with a proposed rate and how the commission would enforce the filing requirement; staff said the requirement will be included in the order and expected the owner to return to the next meeting if needed. The commission approved the transfer by voice vote.

What’s next: Willow Creek must file an updated tariff within 30 days and will be subject to staff review; the commission signaled it will follow up if the owner does not comply.
