The Zoning Board of Appeals tabled a request Jan. 8, 2026 for a setback variance that would legalize an existing gazebo at 46 Havenwood to allow staff and the applicant to produce a drainage plan and site clarifications.
Owner Mike Sullivan said a contractor placed the gazebo on a newly poured concrete pad and that he was unaware of setback requirements; he submitted photos and said the pad created no drainage issues in his view. Neighbor Rick Johnston testified the gazebo sits about 5 feet from the property line, affects neighborhood character and has created runoff/wetness issues that affect his yard and fence. Board members examined photos, discussed grade and flow direction and asked town staff to clarify lot lines and slope.
Several board members suggested conducting a site visit and obtaining a grading/drainage plan or an engineering sign-off; Tim Phillips moved to table the application until the next meeting so the board could get clearer information on drainage and property lines. The motion carried by voice vote.
