Board flags follow-up on Emergis staffing "opt-in" clause and broad concessions language

During the consent-and-contract portion of the meeting, board members flagged several contract provisions for follow-up rather than immediate action.

Pepe Acebo raised a concern about an "Attachment C" in an Emergis health-care staffing contract that includes an opt-in for a dashboard (Sunburst) which the board member said could have larger downstream effects: "If we opt into using the dashboard, the sunburst MSP, then we are supposed to notify all of these other suppliers... that their contracts are now subservient to Emergis," he said, asking staff to consider striking Attachment C or to return with a clearer explanation of financial and operational consequences.

Members also noted that the Republic Services waste-and-recycling RFP had no additional responsive bidders and asked staff to confirm pricing details. A separate concessions contract with Pepsi drew attention because a handwritten vendor note in the packet seemed to extend coverage or guarantees to Asheville Middle School; a board member read aloud the clause noting that "Included in this payment is the guarantee of all Asheville Middle concessions," and asked staff to double-check whether that scope was intentional.

Superintendent's office staff and legal/finance leads said the packets were provided for information and that staff would investigate the flagged items and bring recommended edits or clarifications back to the board. The board did not take any immediate procurement action on these items during the meeting; several contracts were proposed for placement on next week's consent agenda once staff follow-up is complete.
