The Leawood Board of Zoning Appeals voted Dec. 17 to approve a request for a fence-height exception that will allow a new 6-foot wood privacy fence along the rear property line at 2216 West 131st Street (case 68-20252216).
Staff reported the applicant seeks to install a six-foot privacy fence along an alley that separates the lot from attached townhomes; the townhomes and their patios already feature 6-foot fences. Applicant Richard Robinson told the board the alley contains utility boxes and exposed rock; he said HOA tree-trimming earlier in the year removed brush that had previously provided a visual barrier and that the new fence would improve appearance and establish a clear boundary.
Board members asked about property-line placement and possible utility easements; the applicant said his fence contractor will verify any easements and that the fence would be at the applicant's expense. The chair noted this is an exception (not a variance) and that the board needed to be satisfied the effect on adjoining property is minimal and that the fence is compatible with the physical characteristics of adjacent property.
A motion to approve the exception under LDO section 16-4-9.5 was made and seconded and the board approved by voice vote. Staff will provide written notification of approval to the applicant.
