Magistrate orders fines after owner of 2804 S. Atlantic cited for multiple violations

The magistrate found that the property at 2804 South Atlantic Avenue remained out of compliance after a reinspection showed incomplete repairs across multiple issues.

City counsel described eight violations including unscreened trash containers, siding and paint deterioration, exposed unpainted trim, debris and broken or missing windows. The respondent’s representative, realtor Matthew Riley, said he recently obtained authorization to answer and has been coordinating contractors and communications with city staff.

De La Roche ruled the owners not in compliance and issued an Order No. 11. The hearing record states the magistrate ordered a $200-per-day fine until violations are corrected and directed payment of administrative fees within 30 days; the precise fee amounts are recorded within the hearing packet.

Riley told the magistrate he would work with the owners and the city’s list of contractors to bring the property into compliance. The magistrate noted that it is common for owners to ask for a reduction in fines once violations are remedied but said administrative fees must be paid to support credibility in future mitigation requests.
