The Town of Indian River Shores Council on Dec. 11 adopted two ordinances on second reading, voting unanimously to approve both measures.
Ordinance No. 585, described by the town attorney as "an ordinance of the town of Indian River Shores...amending section 116.01 site plan development process for minor modification of approved site plans," passed by roll call. The clerk recorded affirmative votes during the roll call; the mayor announced, "Let the record show the motion passes unanimously." The ordinance updates the town code to clarify minor modification procedures and includes a business-impact estimate, severability, codification and an effective-date clause.
Council then considered Ordinance No. 586, a code amendment incorporating certified recovery residence procedures and reasonable accommodation requests into chapter 161, section 161.14 of the zoning code. The town attorney read the ordinance title and statutory basis, citing Florida Statute section 397.487. Council again moved, seconded and adopted the ordinance on second reading by roll call, with the clerk recording unanimous ayes.
Council members offered no substantive debate on either ordinance during the second readings. Mayor Foley prefaced Item 8b by noting the measure is largely an "unfunded mandate from the legislature" and said it is "likely not gonna have much of any applicability to this community, but we have to do it because that's what we're required to do."
The council took no amendments to either ordinance during the meeting. Both measures were adopted and will take effect as provided in their respective enactment language.
