Cochise County OKs 25-year electric franchise for Arizona Public Service

The Cochise County Board of Supervisors voted unanimously Dec. 16 to adopt Resolution 25-36, granting a 25-year electric utility franchise to Arizona Public Service Co. (APS).

Dylan Hen Haendel, deputy county attorney, told the board the county’s action is required under state law when a public utility uses county rights-of-way. “Today's item is approval of a 25 year electric utility franchise with the Arizona Public Service Company,” he said, explaining the county may impose conditions to protect public safety and require the utility to bear costs and damages related to county roads.

Jessica Perry, public affairs manager for APS, thanked county staff and Haendel, saying the renewal “ensures coordination between both of us.” During the public hearing, resident Tricia Jarodette asked whether the resolution’s reference to a petition by “qualified electors” meant electors of the county or only of the service area. Hen Haendel answered that the statute requires a petition by qualified electors of the entire county.

With no further board discussion, Supervisor Gomez moved approval; Supervisor Antonori seconded. The motion carried 3–0.

The resolution confirms county oversight of APS facilities in unincorporated areas and formalizes conditions the county may attach to work in county rights-of-way. The board recorded no formal protests during the notice period.
