The Smyrna License and Variance Board on Dec. 10 approved a string of variances across the city, while tabling or withdrawing a handful of requests to the board’s Jan. 14, 2026 meeting.
Most approvals came with conditions. Staff repeatedly required owners to obtain building permits, move structures out of required setbacks within 30 days or secure permits within 60 days, and — in one case — to record a stormwater inspection and maintenance agreement with the Cobb County Superior Court.
Among the actions the board approved were: a variance to allow a second accessory structure and retain a permitted pool at 3240 King Springs Road (staff said the pool had been permitted in 2020 but the shed remained and the variance brings the property into compliance); replacement/relocation conditions for a shed on Wayland Court (owner agreed to move the shed and the front-setback request was withdrawn); two Walker Court variances for owner Ronald Waddell to reduce front and side setbacks to accommodate porch and carport work (approved with stipulations such as gutters and fire-retardant paint where required); a new-construction variance for a substandard lot in Smyrna Heights so a renovated house can meet minimum floor-area requirements; and an accessory-structure variance allowing a pool and shed at 965 Church Street contingent on substantial compliance with submitted plans.
The board also resolved a cluster of four variances for 2809 Sherwood Road that together addressed front-yard impervious coverage, overall lot impervious area, and front and side setbacks. Staff told the board the property had unpermitted driveway and carport work beginning in 2022; the owner agreed to remove specified concrete and to install an engineered infiltration device to mitigate stormwater before the board approved the variances with six stipulations.
On licensing, the board granted a privileged pouring license (beer and wine, retail package and Sunday sales) for a convenience store at 2175 Old Concord Road to an owner who said he trains employees to check ID and keeps camera recordings for 180 days. Later in the meeting the board approved an owner/agent change for Applebee’s Restaurants Mid-Atlantic LLC after the agent described companywide ServSafe alcohol training and ID and over-service protocols.
Several items were withdrawn or tabled at applicants’ requests, including a request to increase sign size on South Cobb Drive and multiple Oakdale Court matters; the board approved motions to move those matters to the Jan. 14 meeting or to withdraw them.
