Avon council approves $62,500 settlement to avoid trial in McGee right-of-way case

Town legal counsel reported a verbal settlement in the McGee combination case and recommended council approval to avoid trial scheduled for next July. Counsel said the agreement would require payment of $62,500 for right-of-way acquisition and that the town had already tendered all but $7,400 to the court.

Legal counsel told the council the Redevelopment Commission (RDC) had approved payment because the RDC is funding the acquisition, but the council, as the party to the lawsuit, also needed to authorize the settlement. The council moved to approve the settlement agreement and recorded a roll-call approval.

The council did not discuss alternative settlement amounts in the hearing; staff noted approval would prevent a trial next July.
