District staff presented a nine-month summary of legal fees and public-records activity at the Nov. 19 meeting, reporting $185,006.26 in legal fees invoiced between February and mid-November and approximately $38,005.91 in insurance reimbursements.
Staff said public-records activity had produced about 164–165 requests to date and that legal fees associated with those requests totaled roughly $74,001.96. Presenters listed the types of legal matters driving costs: employment-related litigation, independent investigations, restraining order petitions and complaints filed with state and federal agencies (ERD and EEOC). Staff also noted that some legal costs were paid directly by the district’s insurer and that not all outside counsel invoices had been received by the time of reporting.
Board members asked whether any fees could be recovered from requestors; staff replied that Wisconsin public-records law allows charging for certain costs (locating and reproduction) but not for attorney fees, and said they intend to raise the issue with state legislators to seek statutory updates that reflect modern electronic records burdens.
Staff cited Wisconsin statute 895.4618 (districts’ obligation to pay attorney fees for employees or board members acting in official capacity) and clarified that some employment- and personnel-related legal costs fall under insurance coverage subject to deductibles. The board received the report and discussed operational steps to manage workloads and possible legislative advocacy on records-law reform.
