At a continued hearing for 76 Endicott Ave (DEP file 0610852), Daniel Contero, representing owner Neli Avergo, and contractor Elkin Villegas answered commissioners’ concerns about construction rubble found beneath a dug area.
The chair said rubble—brick, concrete and asphalt—was present under the excavation and instructed the applicants to remove it and replace it with certified clean fill. Commissioners required amended site plans (including the driveway/paver layout and fence/asphalt line), certification paperwork for fill materials, and pre- and post-construction site walks by commission staff before the commission will file the order with the Department of Environmental Protection.
The commission also directed the applicants to install a full French drain in the backyard as a condition of approval and encouraged vegetative cover near the drain to reduce erosion. The applicants agreed to produce amended plans and to coordinate the required site walks; the chair said excavation can begin but noted the order will not be filed with DEP until the amended plans and certifications are submitted.
With those conditions recorded, the commission closed the hearing and approved the notice of intent by voice vote.
