District legal counsel made a formal recusal announcement and reminded board members of obligations under the Political Reform Act before the board recessed to closed session on litigation matters.
Counsel said Director Young "has previously disclosed potential disqualifying financial conflict of interest under the political reform act" in relation to claims filed against the district concerning Seal Cove and that she will recuse herself and not participate in or be present for the closed-session discussion. Counsel advised board members not to use public comment or their official positions to influence the matter, warning that a recused member’s participation could put both the director and the district at legal risk.
At the public session close, the presiding official announced the board would recess to closed session for conference with legal counsel on existing litigation concerning Half Moon Bay and anticipated litigation (up to 12 potential cases) tied to the Seal Cove emergency. The board moved into recess after noting the recusal and giving public thanks to participants.
