Nueces County moves to regulate game rooms, sets Oct. 1 effective date

The Nueces County Commissioners on May 25 adopted an ordinance to regulate game rooms countywide, a contentious item that drew listeners from bingo charities and game-room patrons. After extended public comment and advice from county attorneys, the court approved a version that conforms to state legal guidance on prize types for redemption machines.

Speakers from licensed bingo charities urged enforcement of Texas gaming law and expressed concern that unregulated game rooms had reduced bingo revenue for nonprofits. Patrons and operators urged reasonable hours and safeguards; the court modified proposed hours to permit noon openings on weekends and extended Friday–Saturday hours to 2 a.m., and it set an October 1 effective date to give sheriff and court staff 90 days to build permitting and enforcement capacity.

County legal staff advised that the Texas Administrative Code and Attorney General precedent bar prizes that are effectively cash or fungible gift cards; the court therefore limited permitted prizes to non‑cash tangible items and directed the county attorney to refine language so the ordinance aligns with state TAC and Lottery Commission rules. The court also instructed staff to return with outreach and enforcement plans before the effective date.
