The Woburn Zoning Board of Appeals voted to approve a minor modification to a variance for a front‑setback fence at 113 Mishawam Road.
The request came from Timothy Boss, who said he wants to bring the fence "in" at the back right corner and move the double gate because a steep slope and a 3‑inch raised grade imposed by the conservation commission would otherwise leave a gap large enough for his dogs to get under. "…it's too much of an incline for a double gate…my dogs would be very likely to be able to get under," Boss said during the meeting.
Board members discussed whether the change qualified as a "minor modification" under the board's rules and the zoning code. One member said the corner measurement as shown on the revised plot plan complies with the front setback and therefore the change appears minor. Member (Speaker 2) moved to approve the modification; Member (Speaker 5) seconded and the motion passed by voice vote.
Chair said the board will issue a revised decision referencing the current plan and will notify Mr. Boss when the record is updated.
The board did not require a new advertised hearing because it treated the change as a minor modification to an existing variance.
