Chairman and commissioners reviewed conditions at multiple Montvale Land LLC sites (Hill Street roadway, The Veil) and described significant field issues: erosion, a silted basin and a ponded area that appears to be functioning more like a pond than the designed wetland, full sediment basins, leftover stakes from erosion controls and trash in and around the DOT parking lot adjacent to the development.
Laura Leach of BHB and Joe Allen of Leggett McCall Properties told the commission the contractor has been out to install filter fabric, add rock in basins and build check dams in response to recent rain events; Leach said pictures and a January 10 report documented work underway, but commissioners said the visible trash and stakes warranted delaying any partial certificate of compliance or escrow release. Commissioners discussed partial release percentages previously considered (e.g., 50–75% for certain items, monitoring holdbacks) and emphasized that monitoring obligations remain in place and that the commission may peer‑review wetland function if the site continues to differ from plans.
After extended discussion, Commissioner (Speaker 2) moved to hold off on issuing a partial release of escrow for Montvale Land LLC; the motion was seconded and the commission voted to delay any partial releases until the commission is satisfied the site cleanup, erosion control repairs and monitoring arrangements are in order. Staff and developer representatives agreed to follow up with documentation and to notify the commission when they can confirm remediation.
