Commission postpones vote on ordinance to grandfather retail dog and cat sales after owner and residents speak

County staff presented a draft amendment to Chapter 4 of the Clay County Code (ordinance 2022-14) to permit grandfathering retail sale of dogs and cats at facilities operating as of March 31, 2022, while adding standards for care, records and adoption/rehoming requirements.

Michael Kasnoff, founder of BFF Puppies, and Dawn Raymond, the new owner, described store practices and asked the board to "grandfather in those establishments" to allow continued retail sales (Kasnoff: "I'm here today to speak out in support of the amendment for the ordinance... the retail sale of dogs and cats"). Several commissioners expressed sympathy for the business impact but emphasized the ordinance had originally aimed to curb puppy mills and protect animals; concerns included potential monopoly effects, indefinite grandfathering, pricing transparency and the need for rigorous standards.

Commissioners discussed square footage limits, transferability, and whether a grandfather clause could create a permanent advantage for a single retailer; staff confirmed the draft would allow grandfathering as long as the business remained in operation and could move within the county.

Outcome: the board agreed to take up the item at the next meeting after staff and counsel work through comments from the business' counsel and potential ordinance edits.
