Council approves amendment to 2023 special exception to accept additional engineered fill on FJ Gilmore Lot 6

The council approved an amendment to a previously granted special exception that allows site‑specific overlap grading and additional engineered fill on lots in the FJ Gilmore subdivision.

County counsel and public‑works staff told the council that material volumes discovered after the 2023 approval — largely generated by nearby public projects, including work at the transit site and Paintbrush Drive right‑of‑way adjustments — exceed earlier estimates. Public Works explained the requested change would allow placing additional fill on Lot 6 (technical request rounded to roughly 203,000 cubic yards from a previously permitted ~52,292 cubic yards) and would increase Lot 6’s buildable area from roughly 5.8 acres to about 8.5 acres.

Public Works engineer John Angel said visual and height impacts would be modest — maximum increases of about 2–3 feet in some places — and the change would reduce the number of heavy haul truck trips on local roads. No members of the public spoke during the public hearing on the amendment.

On a motion from Councilmember Roger and second by Tanya the council approved the amendment as contained in the packet. Staff noted a subsequent subdivision‑plat amendment would be required to reflect revised lot lines and that technical grading approvals and construction permits will be processed under normal review procedures.
