The Snyderville Basin Planning Commission voted unanimously on April 9 to approve a conditional‑use permit for a vehicle‑control gate at 2157 West White Pine Lane (project 23S136), citing resident safety concerns and evidence of repeated trespass attempts on the private subdivision road.
Amir Chalice, the senior planner, reminded commissioners that the item came as an administrative review after a public hearing in January and outlined four threshold questions the commission had asked staff to revisit: whether a gate is required, the 900‑foot criterion, the disturbance‑area footprint and any additional conditions.
Rick Nemaroff, president of the White Pine Ranches HOA, told commissioners the neighborhood had recorded "over a dozen trespass attempts" since the January hearing, including instances where vehicles ignored the security guard and one episode in which an individual offered to bribe the guard. Nemaroff said he documented incidents with photographs, video and police reports and argued a gate was needed to "prevent that conflict from happening" and avoid escalation.
Commissioners debated whether the resort/spa and associated lift and eating amenities were the primary traffic generator to the affected area and discussed gate location, visibility, vehicular stacking and disturbance‑area tradeoffs. Staff and engineering indicated that both gate locations discussed could be engineered to meet roadway and stacking requirements, and that lighting must comply with the county's dark‑sky ordinance and will be enforced during building‑permit review. Commissioners requested a plat amendment to widen the right‑of‑way where the gate will be installed; staff said property owners consented to the proposed right‑of‑way adjustment.
A motion to approve the CUP for the vehicle control gate at 2157 W White Pine Lane, "with the clarified findings of fact, conclusions of law, and updated conditions of approval," was moved and seconded and then passed unanimously in roll call: Commissioner Nagy (aye), Commissioner Hawley (aye), Commissioner Mooney (aye), Commissioner Carmichael (aye), Commissioner Cook (aye), Commissioner Hubler (aye), and the chair (aye). The commission recorded no dissenting votes.
Conditions and next steps noted during the hearing included a plat amendment to adjust the right‑of‑way, engineering coordination for stacking and circulation, adherence to lighting and dark‑sky standards through the building‑permit process, and that final permit issuance will follow any required amendments and permit reviews.
Quotations from the hearing included HOA testimony summarizing trespass incidents and applicant responses about visibility and stacking at the proposed gate location. The applicant team will return with the plat amendment and final engineering plans before a building permit is issued.
Outcome: motion approved unanimously; staff to finalize findings of fact, conditions and required plat amendment prior to permit issuance.
