The Snyderville Basin Planning Commission voted 6-0 to forward a positive recommendation to the Summit County Manager on a condominium plat amendment for a nonresidential unit at 2750 Rasmuson Road.
Summit County planner Madeline McDonough told the commission staff reviewed the administrative review application (project 23088) and concluded it met the requirements for approval. McDonough said the proposal would combine Suites 101K, 101J and 101I and add roughly 529 square feet of common area to create a leasing office. "We recommend that you review the proposed amendments, conduct a public hearing, and then forward a positive recommendation to the County Manager based on the conclusions of law, findings of fact and conditions of approval, and the staff report," McDonough said.
During the public hearing a discrepancy emerged between figures in the staff report and the certified drawing. A commissioner asked whether the combined unit would total 1,280 square feet as listed in the staff report or 1,274 square feet as shown on the proposed amended drawing. The applicant said he did not recall how the earlier number was calculated and described the building as an "unusual" condominium configuration made up of many very small units. A member of the meeting record pointed out that if a conflict exists the surveyor's certificate and its legal description govern the recorded measurements.
Commissioners agreed the surveyor's certified measurement should control. Commissioner Convey moved—and Commissioner Kucera seconded—to forward a positive recommendation subject to amending finding of fact number 8 to read 1,274 square feet to match the surveyor's certificate. The commission then voted, with Commissioners Kucera, Cook, Munger, Hawley, Convey and Chair Pat each voting "aye," and the motion passed 6-0.
The commission's recommendation is advisory; the final land use authority on the administrative condominium plat amendment is the Summit County Manager. Planner McDonough confirmed that the amended plat and accompanying CC&Rs would be recorded with the county as required by state law. No substantive public opposition was raised during the hearing.
The commission then moved on to other business, including scheduling an Aug. 8 work session on proposed engineering code changes and a site visit to the Canyons 'wait parcel' ahead of a future review.
