Rising Sun staff propose vendor fees, clarify small-project permits and note sprinkler rule impacts

Town Administrator raised a proposal to require street vendors operating within town limits to obtain a use-and-occupancy permit and pay a monthly fee (suggested $25) so mobile vendors contribute to town fees in a manner more comparable to brick-and-mortar businesses. The administrator said the six-month fee at that rate would run to roughly $225 and that the approach is broadly consistent with fees in nearby towns.

Why it matters: Staff framed the change as an equity and fairness measure for local businesses and a modest revenue stream for the town. Vendors who occupy public or private space repeatedly would pay into the system rather than operating without local costs.

Town Administrator also previewed proposed building-code clarifications that would remove permit requirements for ground-level patios under 100 square feet that do not serve a primary entrance or exit, and create a separate, lower-fee category for small permit work that requires fewer inspections. “So basically, what that's saying … anything under a hundred square feet … doesn't have to have a permit,” the administrator said, explaining the intent to reduce confusion and match fees to inspection workload.

Staff further reminded the board of a 2021 town sprinkler ordinance that requires residential sprinklers for renovation projects exceeding 50% of occupiable square footage. The Town Administrator reported two Valley View townhouse renovation projects will require fire sprinklers under that rule, and said this is a safety improvement for older townhouses.

Next steps: Commissioners asked staff to prepare a resolution and fee schedule for vendor licensing and to bring proposed building-code wording back for consideration at a future meeting. No formal vote occurred on the vendor or permit proposals at this meeting.
