Rising Sun adopts resolution accepting dedication of undedicated portion of Colonial Way

The Town of Rising Sun on April 26 adopted Resolution 2022-09, authorizing the mayor to execute a deed conveying ownership of a 13.73-foot undedicated portion of Colonial Way to the town.

Town Administrator read the resolution into the record and briefed the board on the road’s history: a roughly 633-foot portion of Colonial Way is owned by the Cecil County Board of Commissioners, while a developer-built extension of approximately 13.73 feet beyond that portion was never legally conveyed after construction in the late 1990s. The administrator said the undedicated stretch remains titled to the landowner of a 26.227-acre parcel (tax ID 06-005446, partial 103), complicating financing and a pending sale.

The resolution notes prior development along Colonial Way that relies on that road—Cecil County Library, Stone Run Medical Center, Fairview Senior Housing and a small strip mall—and concludes that, because the extension was not legally conveyed to the county as intended in 1999, the most practical remedy is for the town to accept dedication and execute the attached deed dated April 22, 2022. The administrator told the board the town’s engineers will inspect the road; staff believe it is in acceptable condition for dedication.

A commissioner moved to accept the resolution as read and a second was recorded; after brief clarification that the properties served by the road are already annexed and have town water and sewer, the chair called for the question. The board approved the resolution by voice vote. No roll-call tally was read into the record.

The resolution directs the mayor to execute the deed of conveyance to complete the transfer. The action clears an ownership impediment the administrator said could otherwise prevent a buyer from obtaining financing for the parcel.

The town will publish the executed deed when it is recorded and will notify affected property owners of the transfer.
