The mayor and commissioners of the Town of Rising Sun voted on Aug. 23 to adopt a corrected official zoning map, approving Resolution 2022-16 to fix a mapping error that had incorrectly shown two annexed parcels as R-1 single‑family residential instead of R-2.
Town Administrator (first referenced in the record at SEG 027) told the board that the two parcels, located near Knutsen Track and identified in the resolution as 629 and 635 Joseph Bick Memorial Highway (tax IDs O6-007953 and O6-041973), had been annexed into the town under annexation resolution 2006-3 as R-2 single-family residential. He said the misclassification appeared on subsequent versions of the town zoning map and that the updated map dated Aug. 23, 2022, corrects the error. The administrator described the mistake as a scrivener's error and read the resolution text and legal basis into the record, citing the town zoning code (section 12-1-10) and the prior adoption of the map on July 12, 2022.
An unidentified meeting participant moved to adopt the resolution and another seconded the motion; the transcript records the board voting in favor and the clerk stating "Motion carries 2 to 0." After participants noticed the record lacked the explicit term "approve," the board revisited the item, the motion to approve was repeated and seconded, and the board again recorded unanimous "Aye" responses in the transcript.
Resolution 2022-16 adopts the attached zoning map dated Aug. 23, 2022, as the official zoning map of the Town of Rising Sun and expressly records that the two parcels at 629 and 635 Joseph Bick Memorial Highway are R-2 single-family residential as set by the 2006 annexation. The board did not attach additional conditions or amendments to the resolution at the meeting.
The adopted correction will be reflected in the town's official zoning records; town staff said they keep resolutions in the record to avoid having to search decades of paper files for property determinations. The town attorney indicated a separate memo on other property matters will be circulated to the board.
