Clear Lake council continues appeal of Oglund Canyon cannabis project after teeth-of-water debate

The Clear Lake City Council on Jan. 6 continued a public hearing on an appeal of a planning commission approval for a proposed cannabis cultivation project at 2185 Oglund Canyon Road, sending the matter back to the Jan. 20 council meeting for further consideration.

Neighbors and appellants pressed the council to delay a final decision, saying the technical analysis of the Burns Valley groundwater basin relies on outdated studies and does not account for recent drought and new agricultural growth. “We want to ensure that adding more and more agriculture can be supported before moving forward,” resident Vicky Crystal said, asking the council for a continuance and more current hydrologic data.

The appellant argued that many affected property owners were not given adequate time or notice to assemble scientific rebuttals and that county and city closures over the holidays slowed their ability to gather information. The applicant’s representative, Richard Knoll, opposed a delay, saying the applicants had provided hydrology and water-availability reports to staff and the planning commission and that a last-minute continuance would impose hardship on applicants who 'have really provided the city with all of the documentation and application materials' in a timely way.

The technical dispute centered on competing readings of basin capacity and projected demand. Angie Dodd of Northpointe Consulting Group, who prepared the project’s hydrology reports, told the council the project’s estimated water demand is about 1.8 acre-feet per year for the half-acre cultivation area and employee use, while estimated parcel recharge in a dry year is about 4.2 acre-feet. Dodd summarized her findings: 'The project's demand is only point 1% of the usable storage capacity' of the Burns Valley basin and concluded the single project would not have a cumulative impact but recommended additional monitoring wells to better track seasonal and formation-level differences.

Residents and other commenters disputed the up-to-date relevance of baseline reports. Multiple speakers pointed to the Lake County Groundwater Management Plan (2006) and older Department of Water Resources estimates (cited in evidence as dating to 1960) as insufficient for current planning in a period of prolonged drought and increased vineyard and cannabis cultivation. Appellants asked for a new, local hydrology study or an expanded monitoring program before the council ruled.

On procedural votes, the council recorded a motion to continue the appeal and related hearing; the clerk announced that motion passed 4–1, with Vice Mayor Purdock recorded as opposed. Council members also approved a related motion to continue a development-agreement item to Jan. 20 at 6 p.m.; the clerk later recorded that action as passing unanimously. The council did not take a final vote on the project itself at the Jan. 6 meeting.

What happens next: The public hearing remains open and the matter is scheduled for continued review at the Jan. 20 council meeting at 6 p.m., when the council may hear additional technical information, public comment and formal motions before issuing a final decision or remand.
