Committee approves bill to expand microbrewery privileges and add enforcement discretion

Representative Matt Brown (House District 55) presented House Bill 1498 to clarify and expand permissions for microbrewery restaurant private club permits, particularly in dry counties. Brown said the bill seeks parity with restaurant private club permits by permitting microbreweries to sell beer, wine and spirits; he said the change applies in dry counties and would affect three permittees statewide.

The bill would also allow the Alcoholic Beverage Control (ABC) some discretion when addressing permit violations (moving from mandatory revocation in all cases to a 'may revoke' standard for certain minor violations), permit microbreweries within legally established entertainment districts to participate on the same terms as private clubs, and clarify that advertising using only the restaurant's name is not considered promoting consumption of alcohol (while advertising price or direct encouragement would remain prohibited).

Representative Brown said the changes were meant to remove ambiguity that had discouraged some microbreweries from relying on the statute. John Nabuls appeared to testify but yielded his time. Committee members asked clarifying questions about how the bill would affect dry counties and advertising rules; the sponsor and ABC testimony (earlier in the hearing for related bills) addressed enforcement and discretion. The committee closed debate and advanced the bill by voice vote.
