Council debate over town litigation: differing counts and interpretations aired during public comment

During public comment and council discussion, members aired competing interpretations of a document listing legal matters in which the town is named. Councilor (S4) criticized the number of lawsuits and suggested the council has spent significant money on litigation. Unidentified Speaker (S6) read from the submitted list and said roughly 67 entries showed the town in a case heading but that many on the list were marked closed or unassigned.

"There is in fact, as was represented approximately a 67 cases listed in which the town is mentioned in the heading of the case," Unidentified Speaker (S6) said, adding that many of those on the list are marked "closed." S6 also noted that numerous collection cases are handled by counsel on a contingency basis and generally result in revenue rather than expense.

Councilor (S2) responded that he had not seen the paperwork previously and questioned which of the entries remain open. He said he appreciates the agenda item being raised so the record could be clarified. Councilors debated whether the published list implied 167 open cases or whether many were historical or closed matters dating as far back as 1984.

The exchange produced no formal vote or directive beyond counsel and staff being asked to review the record and provide clarity. Councilors requested that documentation be placed in the record so the public can see which matters are open, closed or collection cases.
