Commission ratifies enforcement order to return pilings at 222 Pleasant St.; historical photos reviewed

The Yarmouth Conservation Commission on Dec. 6 revised and ratified an enforcement order for Bass River Property LLC (222 Pleasant St.) requiring that pilings and the associated float be moved back to their permitted locations. Staff reported that photographs from spring 2024 showed the float and pilings protruded farther into the channel (approximately 11 feet from the landing in recent photos versus about 3 feet previously) and that the 1991 waterways license indicates approximately 6–7 feet of separation.

Bob Perry, representing the Lloyd family, said the Lloyds will coordinate with Lemco Marine to replace the two pilings where they should be according to the most recent plan and that Lemco likely placed them incorrectly during a recent deployment. Perry presented historic 1952 aerial photos showing the dock’s longstanding configuration and argued that moving the pilings to the licensed locations would address the enforcement concern without imposing fines.

Staff recommended revising the draft enforcement order to add time-of-year restrictions and shellfish-protection measures and to require removal and replacement of the pilings to permitted positions. Commissioners moved and seconded to ratify the enforcement order as revised with the special conditions; the motion passed by voice vote. Bob Perry thanked the commission and said the work will proceed promptly.

The action requires the property owners and their contractor to restore pilings to the permitted locations and to follow seasonal restrictions and shellfish-protection steps included in the revised order.
