House passes bill creating commission to evaluate student eligibility in cases of sex/team mismatch

The Utah House on Feb. 16 approved a second substitute to HB 11 establishing a process and a temporary commission to evaluate cases where a student’s registered birth sex and the team designation conflict.

Representative Birkland, sponsor, described a commission composed of medical, statistical and athletic professionals and family representatives that will review individual cases. She said the panel will weigh factors such as height, weight, flexibility and medical history and that the process is not intended to require medical procedures or intrusive body exams. "This commission...will ask a lot of very common sense and important questions to evaluate whether it’s safe for that child and whether there’s a competitive advantage or not," the sponsor said.

Members raised specific concerns about intersex students, privacy protections, and how many athletes would require evaluation. The sponsor estimated roughly 10–12 students might go through the commission based on current numbers and high school association cases. Some members urged caution and said the bill may not be fully settled; others praised the sponsor’s stakeholder outreach and called the proposal a compromise balancing fairness and inclusion.

After a lengthy floor session and a call of the house, the House voted 51 yays and 16 nays to pass the second substitute; the bill will be transmitted to the Senate for further consideration.
