Senate advances measure to allow crime victims to access reparations through advocates without immediate filing

Senator Iwamoto presented second substitute House Bill 228, which modifies eligibility rules for the state’s crime victim reparations fund so victims can receive assistance for forensic exams, counseling, medical and other out‑of‑pocket costs without first initiating a criminal process. The bill permits victims to seek help from an advocate who can complete the necessary questionnaire so the victim may access reparations while deciding whether to begin a law‑enforcement process.

Sponsor Iwamoto described the change as putting help first: "By putting help first, you pave the way for perhaps a stronger, healthier victim, and if the victim chooses to prosecute, which most do, a stronger witness who can aid in the prosecution." The bill also addresses strangulation, requiring victims who suffered strangulation to report it to law enforcement or seek immediate medical care after the incident.

Iwamoto said the bill had broad support from law enforcement groups, forensic nurse examiners, victim service organizations and healthcare providers. The Senate voted to move the second substitute to the third‑reading calendar; the subsequent roll call recorded 28 yea votes, 0 nays and the bill was ordered for third reading.

Floor discussion focused on removing procedural barriers to care so victims can obtain medical and counseling resources without being forced to initiate immediate criminal reporting. The measure attracted bipartisan support on the floor and was advanced toward final consideration.
