Senate requires legislative approval for Utah Lake land transfers tied to restoration plans

The Senate passed second substitute House Bill 240 after floor debate led by Senator Bramble. The bill modifies the authority previously granted under earlier enabling legislation so that any disposal of sovereign land in Utah Lake in exchange for a comprehensive restoration project must be approved by the Legislature and the governor rather than unilaterally acted upon by the Division of Forestry, Fire and State Lands.

Senator Bramble said the change responds to prior law that lacked an express requirement for legislative approval and aims to return major land-transfer decisions to the public through elected representatives. He explained the change converts the division's role from an authority to a recommendatory role and requires the division to prepare recommendations and report objectives to the Natural Resources, Agriculture and Environment Committee.

Senators asked about funding, bonding and collateral for projects; Bramble said bonding would come after a plan is approved and that bonding entities would want assurance that a project is authorized before committing funds. Several senators expressed support and commended prior sponsors for engagement; the bill passed with 27 Yea and 1 Nay.

Next steps: the bill will be signed by the presiding officer and returned to the House for further consideration. Implementation will require legislative and executive approvals before any land disposal under the Utah Lake Restoration Project can proceed.
