Attorney Steven Bellas returned to the commission to request a modification to a prior settlement covering Bluebird Prestige at 170 Orin Oak Lane. Bellas said the modification would not change the footprint or unit count (11 dwelling units) but would convert dens to bedrooms by adding doors and closets, clarifying bedroom counts in the recorded modification.
Commissioners expressed concern about potential secondary impacts such as additional vehicles and parking demand; as Harold Watson observed, increasing bedrooms could raise auto counts and tax assessment implications. Bellas said he had discussed a tentative modification with town counsel Kevin Kelly and that the town had signaled support in principle.
Kristen Minillo, representing the town attorney 27s office, told the commission the town and developer had reached an agreement in principle but needed time to formalize and sign the written modification and asked the commission to postpone final action for about two weeks so that the agreement could be filed with the record. The commission debated whether to approve now and accept the written documentation later or leave the hearing open so the written agreement is in the record; town counsel recommended leaving the public hearing open until the written agreement was submitted.
The commission agreed to leave the public hearing open and return the matter for final action once the written modification was prepared and submitted for the record.
