Senate approves Health and Human Services recodification bills on consent

The Utah State Senate on the morning floor approved a series of recodification bills to merge the Health Department and Human Services Department into a single Health and Human Services Department and to update cross-references and repeals across the code.

Senator Evan Anderegg, sponsor of the package, told the chamber the measures are organizational and technical. "We did not change any of the policy. This is simply a merger," he said while moving Senate Bill 38 and related measures for passage.

The set included Senate Bill 38 (licensing, certifications, recovery services and child support administration), Senate Bill 39 (health care administration and data, including the Utah medical examiner), Senate Bill 40 (health care delivery and targeted repeals), Senate Bill 41 (substance use, mental health and long-term supports), and technical cross-reference bills (SB206, SB207, SB208 and SB209) that update numbering in Titles 4 through 80 to reflect the recodification. Sponsors described the bills as deleting sections no longer relevant after renumbering and carrying forward existing policy in new code locations.

Senators recorded unanimous or near-unanimous voice and roll-call tallies as the bills were read and moved. The clerk and presiding officer recorded final tallies for the individual items; for example, the sponsor reported SB38 passed with a corrected final tally of 26 yeas, 0 nays, and 3 absent. The bills were ordered sent to the House for further consideration.

Because the package was presented as a technical recodification rather than substantive policy change, sponsors and the floor limited extended debate. Legislative staff and committee chairs told the Senate the work will reduce duplication and fix cross references across multiple titles, facilitating administration of health and human services programs under the consolidated department.

The measures will proceed to the House as reported by the Senate.
