The Land Use and Transportation Committee on Oct. 23 continued an ordinance that would create a nonprofit arts-education special use district (SUD) in parts of Bernal Heights to the committee’s Nov. 6 meeting.
Supervisor (transcribed as) Paskin told the committee there was a lack of a quorum at the Historic Preservation Commission and said he would like to move—subject to public comment—to continue the item to Nov. 6. The committee took public comment before voting.
Eileen Bogan, representing SPEAK, spoke in support of forming the nonprofit arts-education SUD for "Assessor's Parcel Number 40 Block Number 49, Lot 01," and described the proposed ordinance’s language as "clear and unambiguous." Bogan asked whether other proposed SUDs meet the Zoning Administrator’s criteria for being "more restrictive," whether they use principally permitted uses versus conditional uses, and whether language across other SUD proposals is equally clear.
After public comment the clerk recorded that President Aaron Peskin had made a motion (restated by the clerk as a motion by Member Peskin) to continue the item to the regular Land Use meeting on Nov. 6. Vice Chair Dean Preston and other members recorded aye votes; the clerk announced there was no opposition and the continuance passed.
Committee members did not take a final vote on the ordinance itself; the item will return to the committee on Nov. 6 for further consideration.
