Committee OKs acceptance of avigation easement for 297 Alta Vista Drive

The Land Use and Transportation Committee on April 4 voted to accept and record an avigation easement over 297 Alta Vista Drive, granted to the City and County of San Francisco by property owner Gabriel Gonzales Jr., as a condition of local project approval.

Chair Supervisor Mirna Melgar said the easement had been conditioned by the San Mateo County Airport Land Use Commission (ALUC), noting it would allow the city the right in perpetuity to regulate the flight of aircraft through airspace above the property and to address noise, vibration and other effects associated with aviation activity. Diana, manager of government affairs for SFO, described the easement as required under the SFO Airport Land Use Compatibility Plan.

Supervisor Aaron Peskin pressed staff on whether the airport or the city would be reimbursed for the administrative and legal costs of accepting and recording the easement. Planning department staffer David Kim said he did not believe the city would be reimbursed and that he had no estimate of staff time or other costs. "I don't believe we're being reimbursed," Kim said.

No members of the public spoke on the item. Chair Melgar moved to send the easement acceptance to the full Board with a positive recommendation; Supervisors Peskin and Dean Preston joined her in a 3‑0 vote to approve the motion.

The committee action forwards the resolution to the full Board of Supervisors; the clerk noted items acted on today are expected to appear on the Board agenda of April 12 unless otherwise stated.
