The San Francisco Board of Appeals on May 19 denied a rehearing request from Robert Corman related to enforcement action regarding unpermitted construction at 2455 Jackson Street.
Board staff summarized the prior determination (complaint 2018015640) that extensive work had been done without permits, including roof-level reframing, infill of lightwells and creation of new living space. Planning and the Department of Building Inspection had previously reviewed the case and the board noted the original hearing record supported the enforcement findings.
For rehearing requests the board requires a showing of manifest injustice or new evidence that was not available at the earlier hearing. Counsel for the appellant indicated their arguments were contained in their written brief and elected not to present new oral testimony. Planning staff and commissioners said the request failed to meet the high standard for rehearing; Commissioner Lazarus moved to deny the rehearing request and the motion carried 3-0.
The board's denial preserves the prior administrative determination in the enforcement case; any further legal remedies would need to follow separate administrative or judicial channels.
