Board grants appeals over 2697–2699 Mission Street; permits to be issued with revised plans

The San Francisco Board of Appeals on the evening under review granted two appeals related to building permits for 2697–2699 Mission Street and approved issuance of permits conditioned on adoption of revised plans dated April 7, 2022.

Julie Rosenberg, the board’s executive director, introduced the matter as appeal numbers 22‑027 and 22‑028 and said the permits were originally issued on March 18, 2022, to Village Fruit SF LLC: commercial permit 202203180291 for a commercial soft‑story retrofit and residential permit 202203180289 for a residential soft‑story retrofit. Rosenberg said the permits reference compliance with “2019 SFEBC chapter 40 per 2019 appendix A4 standards.”

Appellant Laura Callahan told the board, “I am in agreement with the plans that have been provided. I have no further comment.” The permit holder’s representative, Mr. Santos, told the board, “I think that the plans that I, that I revised accommodate both the appellant and the, the building code standards.” Rosenberg noted that the Planning Department and the Department of Building Inspection had previously reviewed the revised plans and found them to be code‑compliant.

Commissioner Honda moved to grant the appeals and modify the permits to require adoption of the mutually approved revised plans dated April 7, 2022. The motion carried on a 5–0 vote: Commissioner Lopez (aye), Vice President Lazarus (aye), Commissioner Chang (aye), President Swig (aye) and Commissioner Honda (mover; aye). Rosenberg then asked both parties to confirm they were waiving their right to request a rehearing so the special‑conditions permit could be processed more quickly; both Callahan and Mr. Santos affirmed they waived rehearing.

With the waivers recorded, Rosenberg concluded the hearing and the board adjourned. No public commenters spoke on the appeals during the meeting.

The board’s action adopts the revised plans dated April 7, 2022, and directs staff to process the special‑conditions permit consistent with that revision and with prior department reviews.
