The San Francisco Board of Appeals on Aug. 2 granted an agreed amendment to a notice of violation for properties at 2861–2865 San Bruno Avenue, accepting language the parties submitted to align the NOV with a recent conditional use authorization.
Appellant counsel Ryan Patterson told the board the parties had worked with staff to reach a resolution and submitted proposed language for the NOV’s “timeline to respond” section. Planning Department zoning administrator Cory Teague summarized the background: violations dating to 2019–2020 involved “work beyond scope” that created unauthorized dwelling units, enforcement and a city attorney settlement followed, and the planning commission later granted a conditional use authorization that established new timelines for permits and remediation. “Part of the conditions of approval had specific actions with specific timelines,” Teague said, and the requested NOV amendment would sync the NOV with those conditions.
Commissioners asked that the board’s action be limited to adopting the parties’ proposed language. On a motion reflecting the Planning Department recommendation and the settlement, the board voted unanimously to grant the appeal with the condition that the NOV be revised to adopt the parties’ proposed language.
The board’s order grants the appeal with that condition and closes the item; the amended schedule is intended to coordinate enforcement deadlines with the planning commission’s conditional-use timeline.
No public comment opposed the settlement during the hearing, and the parties indicated they did not require further presentation.
