Planning commission approves cannabis retailer at 317 Cortland Avenue, citing equity criteria and neighborhood support

The Planning Commission on Oct. 7 approved a conditional use authorization to convert a ground-floor restaurant space at 317 Cortland Avenue into a cannabis retail store, with conditions prohibiting on-site smoking or vaporizing.

Planning staff recommended approval, saying the proposal complies with planning-code buffer requirements and with the city’s equity rules for cannabis licensing. Staff reported three letters in opposition and 55 letters in support. The licensing applicant (Cholo Scott Wolf) was identified in the hearing record as an equity applicant in Tier 1; staff noted the city is nearing completion of processing Tier 1 applicants.

Sponsor representatives described the concept — Mary Modern — as a women-focused cannabis boutique that intends to emphasize social equity brands. "Mary Modern is the unique retail cannabis boutique designed by women with women in mind focusing on alternative health and wellness," a sponsor representative said. The sponsor pledged 30% of shelf space to social-equity brands and said the project would create 18–20 jobs and produce roughly $100,000 in annual tax revenue (figures given by the sponsor).

Commissioners asked clarifying questions about the proximity to K–12 schools and the permit/licensing status; staff confirmed the site is outside the 600-foot school buffer and that conditions would prohibit on-site smoking.

On a motion to approve with conditions, the commission voted 6–0 to grant the conditional use authorization.
