Commission approves discretionary review of 312 Utah Street with privacy and setback conditions

The San Francisco Planning Commission on Jan. 20 approved a discretionary-review application for construction of a new four-story-over-basement, three-unit residential building at 312 Utah Street, adopting staff-recommended modifications to address privacy and noise concerns raised by an adjacent nightlife business.

Staff presented the public-initiated request for discretionary review after the owner of nearby Il Parata expressed concern that the project’s decks and proximity would create privacy and noise conflicts and that excavation and shoring might affect the adjacent building. The staff recommendation memorialized a 5-foot setback for the second and fourth floor decks from the north property line and added 5-foot-high nontransparent privacy screens; staff said detailed excavation and foundation methods are overseen by the Department of Building Inspection.

The Doctor requester (representative for Il Parata) testified about structural and noise concerns and asked for a larger interstitial gap; the project sponsor’s attorney, Ryan Patterson, said the project is code compliant, disputed some claims about prior demolition, and offered to pull decks back and add privacy screens. Patterson said his client had retained a sound engineer and that the sponsors would implement the plan shown in revised drawings.

Commissioners questioned corrected drawings and confirmed revised plans showing internal stair connections and deck modifications had been posted. After deliberation the commission voted unanimously to approve the discretionary review with staff-recommended modifications to setback and privacy screening, and to require building-department review for construction and excavation safeguards.
