Public and neighborhood groups urge city to scrutinize AB 916 and potential effects on local review

During general public comment the Planning Commission heard multiple speakers urging caution about state bill AB 916 and its possible effects on local planning oversight. Bruce Bowen of the Dolores Heights Improvement Club and the San Francisco Land Use Coalition argued a short provision in AB 916 could prohibit hearings for variances and bedroom reconfiguration, with consequences for tenant protections and local review.

"If all this is an accurate reading of the bill ... it's one of the most sweeping, overreaching changes to planning oversight that I can think of," Bowen said, describing scenarios in which hearings could be eliminated and minimum unit sizes could be avoided by reconfiguring units.

Planning staff responded that the language can be read in multiple ways, that staff has reached out to the Mayor's Office and the bill author for clarification, and that they can prepare a memo for commissioners on AB 916 and other state housing bills. Commissioners asked that staff circulate a memo and discuss ongoing state legislation in either monthly updates or through an informational hearing. Several speakers also linked AB 916 concerns to local controversies over demolition and the preservation of existing housing.

Staff did not adopt a definitive legal interpretation at the hearing; they committed to report back with analysis and, if useful, to present the Equity Council and other state-bill updates to the commission.
