The Planning Commission on Sept. 28 approved a conditional use authorization allowing a restaurant in the Mission District to operate an expanded outdoor activity area and extend on‑site alcohol service into an adjacent parking parcel.
Planning staff explained the proposal would remove six parking stalls and convert rear lot space to an outdoor dining area with seating, temporary structures and restrooms. Hours of operation for the outdoor area were limited in staff recommendations to 9 a.m.–10 p.m. to limit evening noise impacts. The restaurant holds a valid ABC Type 41 license and previously operated outdoor dining during the pandemic under a Shared Spaces permit.
Owners and supporters testified the patio provides cultural value, jobs and vibrancy in the Mission; some neighbors and adjacent residents supported the expanded dining. Others raised concerns about a recent amplified event they said was excessively loud; one neighbor said the amplified music “rattled my windows and shook my walls.” Staff and sponsors clarified that amplified outdoor entertainment requires a separate Entertainment Commission permit and, where required, a Temporary Use Authorization.
Commissioner Diamond proposed, and the commission adopted, an amendment that tightened the condition language requiring the project sponsor to obtain necessary Entertainment Commission approvals and to comply with any conditions the Entertainment Commission imposes for outdoor music or amplified sound. The commission also noted Condition 15 requires that project‑related noise not disturb nearby residences and that the applicant designate a community liaison to receive and respond to noise complaints.
The motion to approve the conditional use authorization, as amended to clarify outdoor music permitting under the Entertainment Commission, passed unanimously, 7–0.
Next steps: The applicant must obtain any required entertainment permits and comply with the adopted operational conditions; the Entertainment Commission will adjudicate amplified‑sound permits and may impose additional conditions or hours.
