The San Francisco Unified School District board on Jan. 3 reported out the results of two closed-session items involving anticipated litigation and said it had given direction to its general counsel.
President Mittamity told the board that in the first matter the board “by a vote of 7 ayes gives direction to the general counsel.” In the second matter she said the board voted “6 ayes and 1 recusal,” and that Commissioner Fisher was recused and the board provided direction to general counsel.
The board did not disclose case specifics in open session. President Mittamity earlier in the meeting had announced that on Jan. 3 the district received a letter from Scott J. Rafferty regarding the CVRA and that the board would discuss a potential lawsuit in closed session; she did not tie that letter publicly to the closed-session outcomes.
The board’s action in closed session was limited to direction for counsel; no public vote or substantive legal findings were made in open session, and the board did not provide a timetable for any public updates or filings.
The board moved next to a scheduled progress-monitoring workshop on student outcomes.
