At the Sept. 5 meeting, OCII staff notified the commission of intent to issue a request for proposals for landscape maintenance and related services in Community Facilities District No. 1 (Rincon Point/South Beach). The current contract with Forrester and Kroger (a minority-owned small business enterprise) expires Oct. 31; staff said the new contract would have a similar structure (three-year initial term with a three-year option).
Executive Director Koslovsky said the work covers sidewalks, streetscapes and small open spaces in the former Rincon Point/South Beach redevelopment project area between the Bay Bridge and Oracle Park. "As the CFD administrator we are still responsible for maintenance of these features," Koslovsky said, explaining the redevelopment project area formally expired in 2021 but CFD responsibilities remain.
Commissioners asked whether obligations will eventually transfer to the city. General Counsel Morales and other staff explained there is no authorization under the Mello-Roos Act to transfer CFD administration to another governmental body without a vote of owners/residents (a two-thirds vote); absent state legislation, OCII must continue to manage CFD obligations or pursue other contract arrangements. Staff said the agency will study transitions during contract renewal and provide updates in future budget presentations.
The commission paused for public comment (none) and staff said they would proceed with the RFP and return with procurement results.
