The San Francisco Ethics Commission on Dec. 8 approved its consent calendar, adopted a proposed stipulation in a complaint matter and finalized its draft annual report for fiscal year 2022–23.
On a roll call, commissioners approved consent-calendar items 5–11 unanimously. The panel removed item 12 from the consent calendar for discussion; commissioners questioned aspects of the proposed stipulation and potential penalties before voting to accept staff’s recommendation.
One commissioner questioned the mitigation credit given for amended filings, saying, "I don't see that as a sign of cooperation," and urged caution about counting amended filings as cooperation. Staff counsel explained how the charter establishes penalty caps, including a statutory option up to $5,000 per violation or an alternative cap of up to three times the amount not disclosed; staff said the respondent in the Christian Kitchen matter failed to disclose approximately $1,500,000, which establishes a very high alternative cap although staff opted to collapse violations into a single count in the interest of moving the case along. The commission moved to accept staff's recommendation on item 12 and approved the stipulation on a unanimous roll call.
The commission also considered and voted to adopt a draft annual report for the fiscal year ending June 30, 2023. Acting Director Baikodeau told the commission the report was required by the commission's bylaws and had been delayed because of hiring priorities; staff noted minor improvements since the November draft and invited feedback for final publication. The commission voted to adopt the report on roll call.
Why it matters: the stipulation resolves an enforcement matter on the record, and adoption of an annual report closes the commission’s public accounting of the prior fiscal year.
