Commission approves Brixton permit despite HOA sound study and neighbor opposition

The San Francisco Entertainment Commission approved a limited-live-performance permit for the Brixton at 2140 Union Street on Dec. 20, imposing an internal sound-abatement limit and reiterating Good Neighbor Policy conditions after residents and an HOA raised ongoing compliance concerns.

Deputy Director Azevedo told commissioners the Brixton conducted outreach (21 letters to neighboring properties) but received three opposition packets including a complaint from a Green Street community group and an HOA that provided a Salter & Associates sound study alleging noncompliance. Staff reported the business had been operating entertainment without a permit in late October, agreed to cease activities and worked with staff to return to compliance; inspector Savino has set an internal sound limit that will be adopted as a permit condition.

Owners Adam Snyder and Hugo Gamboa and operations manager Rachel Barrett emphasized long-term neighborhood ties — the Brixton has operated about 11 years — and described security SOPs, manager oversight and efforts to close windows and monitor sound to avoid spillover into residences. "The speakers outside go off no later than 10 p.m.," an owner said, and the manager said staff use decibel-reader apps and the house system has a limiter.

Neighbors and callers objected to trash left in front of the building, glass and sanitation concerns, late-night noise, and what they described as a pattern of insufficient responsiveness to complaints. One caller said trash and glass often remain on sidewalks until afternoons, and another said patrons sometimes congregate in front of residences at late hours.

Staff recommended approval with the Good Neighbor Policy and an internal limit approved at 89 dBA over 97 dBC maximum measured just inside the front door. The commission moved, seconded and approved the staff recommendation by roll call. Commissioners urged ongoing dialog between owners and neighbors and reminded applicants that permit conditions would be enforced and that multiple agencies (including DPH and inspectors) would monitor compliance.

The permit requires the Brixton to implement the internal limit, maintain trash and litter controls, continue outreach, and keep security and complaint protocols to manage patron egress.
